Terms of service
These Terms of Use (hereinafter referred to as the “Terms”) govern the conditions for use of the online shop (hereinafter referred to as the “Service”) provided via this website by TIMY Inc. (hereinafter referred to as the “Company”). All individuals who access or use the Service (hereinafter referred to as “Users”) shall do so in accordance with these Terms.
Article 1: Membership
- The term “Member” shall refer to an individual who applies for membership by consenting to these Terms and completing the registration process as prescribed by the Company.
- “Member Information” shall refer to any information provided by the Member to the Company concerning the Member’s personal attributes, transaction history, and any other related information.
- These Terms shall apply to all Members and shall be binding both at the time of registration and thereafter.
Article 2: Registration
- Provision of Information
At the time of registration, Members shall accurately complete all required fields on the designated registration form, following all provided instructions. The use of special symbols, archaic kanji, and Roman numerals is prohibited; such entries may be modified by the Company as necessary. - Password Management
a. Passwords shall be used exclusively by the registered Member and shall not be transferred, shared, or loaned to any third party.
b. Members shall take full responsibility for safeguarding their passwords, including changing them periodically to prevent unauthorized use.
c. Any actions taken using a Member’s password shall be deemed actions taken by the Member, and the Member shall bear full responsibility for any resulting liabilities, including financial obligations.
Article 3: Change of Registered Information
In the event of any changes to a Member’s name, address, or other registered information, the Member shall promptly notify the Company. The Company shall bear no liability for any damages incurred due to the Member’s failure to update such information. Transactions processed prior to the update shall be handled in accordance with the information on file at the time of such processing.
Article 4: Membership Withdrawal
Should a Member wish to terminate their membership, the Member must personally complete the withdrawal procedure. To initiate the process, the Member shall contact the Company at the following email address: timy@timy-inc.com. The Company will process the withdrawal upon receipt of the request.
Article 5: Revocation of Membership and Liability for Damages
- The Company may revoke a Member’s membership without prior notice in the following circumstances:
a. False information was provided at the time of registration;
b. The Member fails to fulfill payment obligations for purchases;
c. The Member engages in conduct deemed inappropriate by the Company. - A Member shall be liable for any damages incurred by the Company as a result of the following prohibited conduct:
a. Unauthorized use of membership credentials (e.g., Member ID or password);
b. Tampering with or transmitting harmful programs to the Company’s website;
c. Infringement of the intellectual property rights of products handled by the Company;
d. Any other actions in violation of these Terms.
Article 6: Handling of Member Information
- The Company shall not disclose Member Information to any third party without the prior consent of the Member, except under the following circumstances:
a. Disclosure is required by law;
b. The Company determines that disclosure is necessary to protect its rights,
property, or reputation.
- The Company shall manage Member Information in accordance with its Privacy Policy. The Company may use Member Information for the following purposes:
a. Provision and improvement of the Service;
b. Promotion and marketing of the Service;
c. Ensuring proper and effective operation of the Service. - The Company may provide Members with information, including promotional content, via email newsletters or other channels. Should a Member wish to opt out of such communications, they may do so via the method designated by the Company. However, service-critical notifications may not be opted out of.
Article 7: Prohibited Conduct
Members are prohibited from engaging in the following actions while using the Service:
a. Violation of laws, these Terms, or other rules or guidelines established by the Company;
b. Infringement of the rights, interests, or reputation of the Company or third parties;
c. Conduct deemed offensive to public order and morals, including activities harmful to minors;
d. Actions that cause inconvenience, discomfort, or harassment to other users or third parties;
e. Submission of false or misleading information;
f. Transmission or posting of harmful computer programs, viruses, or spam;
g. Unauthorized access to the Company’s servers or systems;
h. Sharing or transferring passwords to or with third parties;
i. Any other conduct deemed inappropriate by the Company.
Article 8: Suspension or Interruption of Service
The Company reserves the right to suspend or interrupt all or part of the Service without prior notice under any of the following circumstances:
a. Scheduled or emergency system maintenance;
b. System overload or unforeseen technical issues;
c. Operational difficulties caused by fire, power outage, or third-party interference;
d. Other circumstances in which the Company deems suspension unavoidable.
Article 9: Modification or Discontinuation of Service
The Company may, at its sole discretion, modify or discontinue all or part of the Service without prior notice to Users.
Article 10: Disclaimer
- The Company shall not be liable for any damages incurred by Members resulting from interruptions, delays, malfunctions, or data loss caused by communication failures or unauthorized access.
- The Company makes no warranty that emails or content originating from its website, servers, or domain are free from viruses or other harmful elements.
- The Company shall not be held responsible for any damages incurred by a Member as a result of the Member’s violation of these Terms.
Article 11: Amendments to the Terms
The Company reserves the right to amend these Terms at any time or to establish supplemental terms (“Supplemental Terms”). Such amendments or supplements shall take effect upon their publication on the designated website of the Company. Members shall be deemed to have consented to the amended or supplemental Terms upon continued use of the Service thereafter.
Article 12: Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. In the event of any dispute arising in connection with these Terms, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
